Almost, 17.1 RC2 is just 3 or 4 commits behind.
No problem here with dvb-t channels, h264. Just like the previous versions. If in your country/provider it is mpeg-2, and you are not using RPi 3, it maybe worth buying th mpeg-2 license.

There is no reason to update for now only to include 3 or 4 commits, and it won't solve your problem.
How do you have your setup connected ? HDMI, DACs, external soundcard, etc ? Please give more information.
Did you made any changes to audio/video configuration ? Can you check if the problem still exists with a clean Kodi settings (moving/removing /home/pi/.kodi) ?
Please provide your Kodi log to check your problem.

This is (I think) because Kodi hides itself and runs omxplayer in fullscreen but since omxplayer outputs to overlay and preserves the aspect ratio, it does not expand the overlay to the entire screen (otherwise the video would be stretched from 4:3 to 16:9 which is ugly) so here is this weird effect.

what is the solution for this problem ? I have the same with latest Kodi on Jessie

Edit:
okay I have changed some settings and I think this was caused by a faulty setting of refreshrate.
I had 59.94 hz set and changed it back to 60 hz

ReEdit:
okay this is strange .. for some videos it works like it should but other resolutions has the problem like in picture that I made.
With Libreelec it works but here in Jessie Kodi not.

How to fix this ?

There is now Kodi 17.1 (latest stable) available on Raspbian (Raspberry Pi Foundation Repo), which is the same in PiPplware repo, and is confirmed to work just fine. It is always advisable to run the latest stable version. If for some reason you need an old version, they are still available on PiPplware repo. After adding the repo, you need to downgrade kodi packages (check versions with apt-cache policy packagename), and install them specifying the respective version you want. Then you need to hold kodi and kodi-bin packages, at least, so they aren't updated later with the rest of system packages.

first of all thanks for reply!

I tried to install kodi 17, but I can't execute it, I only see a black screen and if I try to launch from command line typing only "kodi" I see this message error:

I just installed the new 17.1 version from the Foundation repository on one of my systems (a Raspberry Pi 2 using an Air Mouse for control).
The mouse cursor is rather jerky and the auto-scrolling feature of the new default skin makes it almost unusable with an Air Mouse (it's impossible to select anything from a long list). But after installing the old confluence skin again it works really well.
